Justices of the Peace In Na H-Eileanan an Iar

Members of the public may occasionally require documents to be signed by a Justice of the Peace. These duties were formerly undertaken by a number of Justices known as “signing Justices” as well as those Justices who sit in court (known as bench serving Justices).
The Criminal Proceedings etc. (Reform) (Scotland) Act 2007 abolished the role of signing justices. Documents which require the signature of a Justice of the Peace may still be signed by a bench serving Justice. There is currently one bench serving Justice in the Western Isles, Iain Macleod, who may be contacted by telephoning 0779 358 2346 or, during normal business hours, 01851 702445.
In addition local Councillors may also undertake some of the signing duties undertaken by Justices of the Peace. A councillor may sign the following type of document;
- Any document for the purpose of authenticating another person's signature;
- Written declarations;
- A document confirming something that the Councillor personally knows to be true (including certifying passport photographs); and
- A document expressing a Councillor’s opinion (for example that a person is a fit and proper person to hold a particular licence).
Generally a Councillor will be able to sign documents that say a Justice of the Peace may sign. However, a Councillor may not sign sworn statements (written records of something said on oath). Please see Council Member section for councillor contact details.
