Answer
Thank you for your recent request submitted under the Freedom of Information (Scotland) Act 2002. The current independent specialist SEN schools that the Comhairle place young people 16 years of age or under within are Camphill School, Aberdeen and Daldorch House School, East Ayrshire.
Whilst the Act creates a general right of access to information held by a Public Authority, this access is not unrestricted and is tempered by a number of statutory exemptions. The Comhairle considers that the information which you have requested is exempt from disclosure under Section 38 (1) (b) as the numbers are so small (less than five) that individuals may be identifiable; therefore the information could be considered personal data within the meaning of the Data Protection Act 1998.
