In accordance with the Scottish Executive’s Code of Guidance on Homelessness (May 2005), Comhairle nan Eilean Siar has established the Environment and Protective Services Panel to allow applicants who feel their case has not been dealt with fairly to have their case reviewed.
Procedure Prior to a Hearing of the Panel
Applicants applying for accommodation may appeal against the Comhairle's decision on their application, offer of temporary accommodation and/or permanent accommodation within 21 days of receipt of the written decision.
The assessment decision letter will advise applicants of their right to appeal and provide details of the appeal procedure.
The Appeal should be in writing to the Director for the Development Department, Council Offices, Sandwick Road, Stornoway.
An initial Appeal will be investigated by the Director for the Development Department, who will reassess the Homeless determination and inform the applicant of the outcome of the investigation. If the applicant is still unhappy with the outcome, they can request that their case goes before the Comhairle’s Environment and Protective Services Panel.
Wherever possible, a Hearing will be held within 7 working days of the Appeal having been received but, certainly, within 14 working days. The Appeal will normally be held at the Comhairle office closest to the Applicant's residence.
Where appropriate, temporary accommodation provision will be maintained during the period of the Appeal.
