Planning information and personal Data
We will take all reasonable precautions to protect personal data (e.g. e-mail address, telephone number and signatures), from accidental or deliberate loss or unauthorised disclosure. Who will control my data?
Comhairle nan Eilean Siar are registered as a data controller with the Information Commissioner’s Office (registration number Z7313689) and have published a Privacy, Personal Data and Website Security notice.

How we will use the information about you
All applications and notifications received by the Planning Service of Comhairle nan Eilean Siar are processed in accordance with the provisions of the Town and Country Planning (Scotland) Act 1997, Planning (Listed Buildings and Conservation Areas)(Scotland) Act 1997 or the Planning (Hazardous Substances) (Scotland) Act 1997 (as amended) and their related regulations.
Your information will be used by Comhairle nan Eilean Siar for the purpose of registering, validating and determining the application submitted. The information will be made available on the public register, and this will include the name and address of the applicant, or the name of the applicant and name and address of the agent, where applicable. Personal email address, signatures, contact numbers and any financial information will be redacted from public viewing but we will hold this information within our planning system for lawful purposes.
Your information could also be used to contact you or your agent, if applicable, regarding the application for the following reasons:
- If there are validation requirements
- To acknowledge registration of a valid application
- If there are representations to the application
- If the application is being heard at a committee
- If the application needs to be revised
- If the application is withdrawn or returned
- When a decision is made
Who else will we share your information with?
We will only use this information in conjunction with your application. Your information (excluding personal contact numbers, email address and signatures) will be shared with statutory and other consultees.
This is a statutory requirement under the Town and Country Planning (Scotland) Act 1997.
How will we look after your data?
Information Security
Access to your information will only be made to authorised members of staff who are required to process it for the purposes outlined in this privacy notice. Please note that anyone who has access to the internet can view the planning applications online, even if they have not registered as a user.
Accuracy of your information
We will process the information given at the time of your application. If your information is not accurate you can let us know by email at planning@cne-siar.gov.uk or by telephone on 01851 822690 or 01870 604990. If you have appointed an agent you should contact them in order that they contact us to amend your data.
How long will we keep this information for?
All planning applications are held on a public register and will not be deleted as they form the planning history of a property. The information held will be that relevant to the planning history including planning decisions, the exercise of permitted development rights, and for condition monitoring purposes.
Why do you need my information?
You have asked us to provide you with a planning service, so we need your name, address and payment details. Without them we will not be able to provide you with that service.
